Justice Dept. sues AmerisourceBergen, accusing it of fueling the opioid epidemic - The Philadelphia Inquirer

The Department of Justice has filed a civil suit against Conshohocken-based AmerisourceBergen, one of the largest wholesale pharmaceutical distributors in the country, and two of its subsidiaries for failing to report suspicious opioid orders to federal law enforcement, which authorities contend contributed to the opioid epidemic. The company failed to report at least "hundreds of thousands" of suspicious orders from 2014 to the present, according to the department. If found liable, the company could be forced to pay billions in civil penalties. The complaint was filed in the U.S. District Court for the Eastern District of Pennsylvania and alleges AmericsourceBergen violated the Controlled Substances Act, which requires companies to monitor controlled substance orders for any irregularities that signal they're being diverted for illegal use. Those medications include acetaminophen and muscle relaxers. Experts recommend a slew of other treatments to help manage pain. Back pain is one of the leading causes of disability worldwide, according to the World Health Organization (WHO), but treating it can be tricky. After all, what works for one person may have little effect on someone else. Still, there are mainstays of back pain treatment, including using muscle relaxers, acetaminophen, and, in more severe cases, narcotics. But new research suggests that those methods of treating back pain may not be the best. Given common questions of fact and law over the adequacy of the Tylenol pregnancy warnings, the U.S. Judicial Panel on Multidistrict Litigation (JPML) established coordinated pretrial proceedings late last year, centralizing all lawsuits brought throughout the federal court system before U.S. District Judge Denise Cote in the Southern District of New York, as part of a federal multidistrict litigation (MDL). In January, Judge Cotes ordered plaintiffs to submit proposed language that could have been added to the acetaminophen labels, showing what the drug makers could have done to warn women about the risks of using Tylenol during pregnancy. Levosimendan, an investigational therapy for pulmonary hypertension associated with heart failure and preserved ejection fraction (PH-HFpEF), was found to improve workings of the kidneys in PH-HFpEF patients with kidney impairment in a Phase 3 clinical trial. Findings from the study, " Differential effects of levosimendan and dobutamine on glomerular filtration rate in patients with heart failure and renal impairment: a randomized double-blind controlled trial, " were published in the Journal of the American Heart Association .
